I would like to make a request under the FOIA 2000 to secure an answer to the question posed below. I would like the description of the incidents you provide to be clear about whether the incident involved paper or electronic data loss. If you wish to apply an exemption to prevent release of this information please provide both the exemption and some narrative about why you believe the exemption to be engaged.
Can you provide me with details of data loss incidents which have resulted in service users or staff making claims for compensation for loss of their personal data? To be clear I am not asking for details of ICO action taken against your organisation but action brought by service users or staff seeking the Right to an effective judicial remedy / Right to compensation and liability under General Data Protection Regulation (‘GDPR’) Articles 79 & 82. Can you provide details of all claims made including those still unsettled? The detail I require should include a description of the data loss incident and how much compensation was paid to the data subject(s) in each case.

I can confirm our Trust has not suffered any data loss incidents which resulted in service users or staff seeking the Right to an effective judicial remedy / Right to compensation and liability under General Data Protection Regulation (‘GDPR’) Articles 79 & 82..
